Terms of Service

These Terms of Service ("Terms") govern your access to and use of Soketify ("Service"), a managed WebSocket infrastructure service operated by Soketify ("we," "us," or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

Soketify provides managed WebSocket infrastructure that is protocol-compatible with the Pusher Channels API. The Service includes WebSocket connection handling, channel management, real-time event delivery, a REST API for triggering events, an authentication system, a management dashboard, and usage monitoring. The Service is provided as-a-service; we are responsible for operating the underlying infrastructure. You are responsible for how you integrate and use the Service in your applications.

2. Accounts

To use the Service you must create an account using Google or GitHub OAuth. You must:

  • Provide accurate and current information
  • Keep your credentials and API secrets confidential
  • Notify us immediately of any unauthorized use support@soketify.com
  • Be at least 16 years of age, or have parental consent where required by applicable law
  • Be responsible for all activity that occurs under your account

One account per individual or organization. We reserve the right to refuse registration or cancel accounts at our discretion.

3. Acceptable Use

You may use the Service for any lawful purpose. You may not use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Transmit malware, viruses, or malicious code
  • Attempt to gain unauthorized access to the Service, its infrastructure, or other users' accounts
  • Conduct denial-of-service attacks or intentionally overload the Service beyond your plan limits
  • Resell or sublicense raw access to the WebSocket infrastructure without our written permission
  • Scrape, reverse-engineer, or create derivative works of the Service in ways not permitted by these Terms
  • Transmit or store content that is illegal, hateful, or violates third-party intellectual property rights
  • Circumvent rate limits, connection limits, or other plan restrictions

We reserve the right to suspend or terminate accounts that violate this section, with or without prior notice.

4. Plans, Billing, and Payment

4.1 Plan Limits

The Service is offered on a tiered subscription model. Each plan includes limits on concurrent WebSocket connections, monthly messages, and number of apps. Plan details and pricing are published at soketify.com/pricing. We reserve the right to modify plan limits or pricing with 30 days' notice to existing subscribers.

4.2 Billing Cycle

Paid subscriptions are billed monthly on your billing day (the day of the month you first subscribed). Billing is processed through Wompi. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.

4.3 Failed Payments

If a payment fails, your account will be marked as past due. You will receive email notification. If payment is not resolved within 14 days, we may restrict access to the Service. You remain responsible for any unpaid amounts.

4.4 Cancellation

You may cancel your subscription at any time from the billing page in your dashboard. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial months except where required by applicable law.

4.5 Overages

If your usage significantly exceeds your plan limits, we will notify you by email. We may, at our discretion, temporarily restrict new connections or events rather than automatically charging overages. Persistent overages may require an upgrade to a higher plan.

5. Service Availability

We target 99.9% monthly uptime for paid plans. Scheduled maintenance will be announced at least 24 hours in advance when possible. Unplanned outages will be communicated via our status page and email. The free tier is provided on a best-effort basis without uptime guarantees. We are not liable for downtime caused by third-party infrastructure providers (Cloudflare, Hetzner), force majeure events, or actions outside our reasonable control.

6. Commercial References and Demos

By using the Service, you grant us the following rights unless you opt out:

  • Customer reference: We may identify you or your company (including your name and logo) as a customer of Soketify on our website, in sales presentations, investor materials, and other marketing collateral.
  • Usage statistics: We may include anonymized or aggregated usage data derived from your account (e.g., "X million messages per month") in public benchmarks, product demos, blog posts, and marketing materials. Such data will never be attributed to you individually without your explicit consent.
  • Case studies: With your explicit written consent, we may feature your company as a named case study.

To opt out of being listed as a customer reference at any time, email support@soketify.com. Opting out does not affect your ability to use the Service.

7. Intellectual Property

Our IP: Soketify and its licensors own all right, title, and interest in the Service, including software, design, branding, and documentation. These Terms do not grant you any ownership rights in the Service.

Your IP: You retain all rights to the data and content you transmit through the Service. By using the Service, you grant us a limited, non-exclusive license to process your data solely to operate and provide the Service.

Feedback: If you submit feedback, suggestions, or ideas about the Service, you grant us an irrevocable, worldwide, royalty-free license to use and incorporate that feedback without any obligation to you.

8. Confidentiality

We treat your App Secrets, API credentials, and the content of messages transmitted through your WebSocket apps as confidential. We will not access, read, or disclose this information except as required to operate the Service, comply with legal obligations, or as described in our Privacy Policy. You are responsible for keeping your own credentials secure and for rotating secrets if you believe they have been compromised.

9. Account Suspension and Termination

By you: You may delete your account at any time from your dashboard. All your apps, secrets, and usage data will be deleted within 30 days.

By us: We may suspend or terminate your account with or without notice for:

  • Violation of the Acceptable Use policy (Section 3)
  • Non-payment of subscription fees
  • Providing false information during registration
  • Any activity that poses a security risk or legal liability to Soketify or other users

For non-urgent violations, we will attempt to provide 7 days' notice before termination. For security or legal violations, we may act immediately. Upon termination, your access to the Service ceases and your data will be deleted per our data retention policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOKETIFY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Service Credits for Downtime

In the event of unplanned downtime affecting your ability to connect to or transmit messages through the Service, you may be eligible for a service credit against future subscription fees, calculated as a percentage of your monthly subscription amount based on the duration of downtime occurring during a calendar month:

  • Less than 1 hour: No service credit
  • 1 hour to 4 hours: 10% of monthly subscription fee
  • More than 4 hours: 25% of monthly subscription fee

Downtime is measured from the time we become aware of the incident until the Service is fully restored and verified. Downtime caused by scheduled maintenance (announced at least 24 hours in advance), third-party infrastructure providers (Cloudflare, Hetzner), force majeure events, or actions outside our reasonable control is excluded from this calculation. To claim a service credit, you must notify us in writing within 30 days of the incident. Service credits must be used within 12 months and do not constitute a refund.

Service credits are your sole remedy for any failure or delay in Service availability or performance. These service credits do not apply to claims arising from our willful misconduct, gross negligence, breach of confidentiality obligations, or violations of law, which remain subject to applicable law without limitation.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Soketify, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) content or data you transmit through the Service; or (d) your violation of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of El Salvador, without regard to its conflict of law provisions. For users located in the United States, any dispute arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

If arbitration is not enforceable in your jurisdiction, you agree to submit to the exclusive jurisdiction of the courts of El Salvador. Notwithstanding the foregoing, Soketify may seek injunctive or equitable relief in any jurisdiction to protect its intellectual property or confidential information.

14. General Provisions

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Soketify regarding the Service and supersede any prior agreements.

Severability: If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.

Notices: We will provide notices via email to the address associated with your account. You may send notices to legal@soketify.com.

15. Changes to These Terms

We may update these Terms at any time. For material changes, we will provide at least 14 days' notice by email before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your account before the effective date.
